1. Nature of Service and Instant Delivery
Gulf Capital Intelligence ("GCI"), operated by Boost My Business AI Innovation Limited (Trade Licence CL11954, DIFC Innovation Hub, Dubai International Financial Centre, Dubai, UAE), is a digital, AI-powered investment screening intelligence platform. The service is classified as a digital content product delivered electronically.
When you subscribe to a plan or generate a conviction report, the following occurs immediately and irreversibly:
- Your request is processed by our proprietary multi-engine AI intelligence system.
- A bespoke conviction report is generated specifically for your investment scenario.
- The report is delivered instantly to your screen and becomes available in your account.
- Server-side computational resources, AI processing capacity, and API credits are consumed in generating your report.
Because the service is performed and delivered in full at the moment of generation, it cannot be "returned," "unused," or "reversed." The digital product has been fully consumed at the point of delivery.
2. No Refund Policy
This no-refund policy applies to all payment types including:
- Monthly and annual subscription plans (Conviction Screen, Due Diligence, Intelligence Retainer).
- One-time report purchases or credit top-ups.
- Promotional or discounted purchases.
- Free trial conversions to paid plans.
Partial refunds, pro-rata refunds, and credits for unused portions of a subscription period are not available. When you subscribe, you are purchasing access for the full billing period, and that access is granted immediately.
3. Subscription Cancellation
You may cancel your subscription at any time to prevent future billing. Cancellation does not entitle you to a refund for the current or any previous billing period. Upon cancellation:
- Your access continues until the end of the current paid billing period.
- No further charges will be made after the current period expires.
- Previously generated reports remain accessible in your Report History.
- No pro-rata refund or credit is issued for unused days in the billing period.
To cancel, use the "Manage Subscription" option in your account settings, which connects to our Stripe Customer Portal. You may also email difc@gulfcapitalintelligence.com to request cancellation. Cancellation requests are processed within one business day.
4. Pre-Purchase Acknowledgement
Before completing any purchase on the GCI platform, you are required to explicitly acknowledge the following:
- You understand that GCI is a digital service delivered instantly upon request.
- You consent to immediate performance of the service, waiving any cooling-off or withdrawal rights that may otherwise apply under consumer protection laws in your jurisdiction.
- You acknowledge that the digital content cannot be returned once delivered.
- You agree that all purchases are final and non-refundable.
- You have read and accepted these Refund and Cancellation Terms, the Terms of Use, and the Disclaimer.
This acknowledgement is captured and timestamped in our system at the point of each transaction and serves as documented consent.
5. Chargeback and Dispute Policy
If a chargeback or dispute is filed against a legitimate transaction on the GCI platform, we will:
- Submit comprehensive evidence to the payment processor and issuing bank, including: your account registration details, email verification records, IP address and device information at the time of purchase, timestamped records of service delivery (report generation logs), your explicit acceptance of these terms at the point of purchase, and full documentation of the digital service delivered.
- Contest the dispute formally through the card network's dispute resolution process.
- Immediately suspend your GCI account pending resolution of the dispute.
- Reserve the right to pursue recovery of the disputed amount plus administrative costs through DIFC Courts if the chargeback is upheld despite legitimate service delivery.
We maintain complete server-side logs of every transaction, report generation request, report delivery, and user session. These records constitute compelling evidence that the digital service was requested, authorised, delivered, and consumed by the account holder.
6. Evidence We Maintain for Every Transaction
For each paid transaction on the GCI platform, the following evidence is automatically recorded and retained:
- Account verification: Email address, verification code confirmation, account creation timestamp.
- Purchase authorisation: Stripe payment intent ID, card fingerprint, billing address, transaction timestamp, amount, and currency.
- Terms acceptance: Timestamped record of the user's explicit acceptance of Terms of Use, Refund Policy, and Disclaimer at the point of purchase and at each report generation.
- Service delivery proof: Report generation request timestamp, report ID, report content hash, report delivery confirmation, and the full text of the delivered report.
- Usage evidence: Session logs showing the user accessed, viewed, and interacted with the delivered report (scroll events, copy actions, PDF/Word export requests).
- Technical metadata: IP address, user agent, device fingerprint, and geolocation data at the time of purchase and service delivery.
7. Exceptions
- Duplicate charges: If you are charged more than once for the same transaction due to a technical error, the duplicate charge will be refunded within 5 to 10 business days upon verification.
- Platform failure: If a paid report generation request fails entirely due to a confirmed platform-side technical fault (not a timeout, not a content quality concern) and no report is delivered, a credit or refund may be issued at our discretion.
- Unauthorised transactions: If your account credentials were compromised and an unauthorised purchase was made, we will investigate and may issue a refund upon verification of the unauthorised access. You must report unauthorised transactions within 48 hours.
In all exception cases, please contact difc@gulfcapitalintelligence.com with your transaction details. Exception requests are evaluated within 3 business days.
8. International Customers
This policy applies uniformly to all customers regardless of geographic location. By purchasing from the GCI platform, you agree that:
- The transaction is governed by DIFC law (Dubai International Financial Centre), UAE.
- Any local consumer protection laws that might otherwise provide cooling-off periods or withdrawal rights for digital services are waived by your explicit consent to immediate service delivery at the point of purchase.
- The DIFC Courts have exclusive jurisdiction over any disputes arising from transactions on this platform.
- You are responsible for any applicable taxes, duties, or charges imposed by your local jurisdiction on digital service purchases.
9. EU/UK Digital Content Rights Notice
If you are located in the European Union or United Kingdom, you acknowledge that under the Consumer Rights Directive (2011/83/EU) and equivalent UK legislation, you have the right to a 14-day cooling-off period for online purchases. However, this right does not apply to the supply of digital content that is not supplied on a tangible medium (such as AI-generated reports) where:
- The consumer has given prior express consent for performance to begin before the end of the withdrawal period, and
- The consumer has acknowledged that they will lose their right of withdrawal once performance has begun.
By checking the acknowledgement box and completing your purchase on the GCI platform, you provide this express consent and acknowledge the loss of your withdrawal right.
